Terms of Service
Last updated: October 2026
These Terms of Service ("Terms") govern the use of Domyko (the "Service") available at domyko.pl, operated by Digital Vantage, Andriollego 34, 05-400 Otwock, Poland, VAT ID PL5321813962 (the "Operator"). The Polish version prevails.
1. Definitions
- Service - the Domyko client portal for accounting offices
- Office - a business running an accounting office that has an agreement with the Operator to use the Service
- User - the Office and the people it gives access to its Account (the owner and staff)
- Office Client - a person or company the Office provides accounting services to and has added to the Service; Office Clients use the Service at the Office’s invitation and have no agreement with the Operator
- Account - the Office’s account in the Service
- Subscription - a paid plan of the Service that renews automatically for further billing periods
- Consumer - a natural person entering into an agreement not directly related to their business or profession
- Sole trader with consumer rights - a natural person entering into an agreement directly related to their business where the agreement is not of a professional nature for them (Art. 38a of the Polish Consumer Rights Act)
2. Acceptance
By creating an Account, the Office accepts these Terms, including the data processing terms in section 6. If you do not accept any provision, do not create an Account.
3. Services
The Service lets the Office:
- Keep a list of documents expected from Office Clients for each period
- Send Office Clients e-mail and text reminders and links to upload documents
- Receive documents from Office Clients and read data from them
- Fetch Office Clients’ cost invoices from the National e-Invoice System (KSeF) and collect their descriptions
- Tell Office Clients the amounts and deadlines of taxes and contributions
- Export data and files to the Office’s accounting program
- Show the Office’s name, logo and colours in the portal and e-mails, depending on the plan
The Service does not keep books, issue invoices, send invoices or tax returns to authorities, or replace the Office’s accounting program.
Using the Service requires a device with internet access, a current version of Chrome, Firefox, Safari or Edge with JavaScript and cookies enabled, and an active e-mail address. Fetching invoices from KSeF requires the Office’s KSeF certificate or a token provided by the Office Client.
4. Rules of Use
Users must use the Service lawfully and in line with these Terms. It is prohibited to:
- Upload files containing malware
- Upload content that is unlawful or unrelated to the accounting services for Office Clients
- Add data of people the Office has no legal basis to process
- Send messages through the Service to people who are not Office Clients or their representatives
- Attempt to access other Offices’ data or bypass the Service’s limits and safeguards
5. KSeF
- The Office is responsible for holding KSeF permissions to read the invoices of the Office Clients whose invoices it fetches through the Service
- The Service uses the certificate or token only to read Office Clients’ cost invoices and sends no documents to KSeF
- Invoice availability depends on KSeF, which is run by the Polish Ministry of Finance; KSeF outages are not a lack of conformity of the service
- The Office may remove the certificate or token from the Account at any time; the Service then stops fetching invoices
6. Data Processing
The Office Client (and, for data in documents, their staff or business partners) is the controller of Office Clients’ personal data, and the Office processes it on the client’s behalf. For that data the Office sub-entrusts processing to the Operator (Art. 28(4) GDPR) on these terms:
- Subject and purpose: storing and sharing documents, invoices and their descriptions and sending notifications — only to provide the services in section 3, for the term of the agreement
- Scope: identification and contact data of Office Clients and their representatives, data in accounting documents and invoices, tax and contribution data
- The Operator processes the data only on the Office’s documented instructions; using the Service’s features counts as such an instruction
- People with access to the data on the Operator’s side are bound by confidentiality
- The Operator applies the security measures described in the Privacy Policy and helps the Office respond to data subjects’ requests
- Further processors are listed in the Privacy Policy; we notify the Office by e-mail 14 days before adding or replacing one, and the Office may object and terminate the agreement
- The Operator informs the Office of a personal data breach without undue delay and no later than 36 hours after detecting it
- The Office may audit the processing of the entrusted data at an agreed date, no more than once a year
- After the agreement ends the Operator deletes the entrusted data within 30 days unless the law requires it to be kept; before that the Office can download an export
7. User Responsibility
The Office is responsible for:
- The legal basis for processing the Office Clients’ data it enters into the Service
- The content of messages and documents sent through the Service
- Keeping Account credentials confidential and granting staff access
- Checking data read automatically from documents before booking it
8. Limitation of Liability
We do not guarantee:
- Uninterrupted availability of the Service
- Absence of errors or technical faults
- Error-free reading of document data — reading is an aid, not bookkeeping
- Availability and accuracy of data in external systems, including KSeF
The Operator’s maximum liability to the Office is limited to the fees the Office paid in the last 12 months.
The exclusions and limitations of liability in this section do not apply to Consumers or Sole traders with consumer rights. Their rights, including those for a lack of conformity of the service, arise from the law and these Terms do not limit them.
9. Plans and Payments
Plans differ in the limit of active Office Clients and in features. Details are on the pricing page.
- Prices on the pricing page are net. VAT is added at the rate applicable to the Office — 23% for buyers in Poland
- Payments are processed by Stripe Payments Europe, Ltd. — the Service does not store card details
- The Subscription renews automatically for the next billing period until cancelled
- You can cancel at any time in the billing portal; cancellation takes effect at the end of the paid period and access remains until then
- Plan changes during a period are prorated for the remaining time
- The trial lasts 30 days and is free. After it ends, further use of the Service requires a Subscription
We announce price changes by e-mail 30 days in advance. A new price applies from the next billing period; until then the current price applies.
For Consumers and Sole traders with consumer rights, a new price applies only once accepted in the dashboard. Without acceptance the subscription ends with the paid period, at no extra cost. Other Offices may cancel before the new price takes effect; not cancelling means accepting the new price.
10. Invoices
- For every payment the Office receives a payment confirmation by e-mail
- An Office that provided a tax ID (NIP) receives a VAT invoice issued in the National e-Invoice System (KSeF)
- By accepting these Terms, the Office agrees to receive invoices electronically
- The tax ID given at checkout goes on the invoice. An invoice issued without a tax ID cannot later be corrected to add company details, so please provide it before paying
- Invoices are available in the billing portal for the whole term of the agreement
11. Right of Withdrawal
This section applies to Consumers and to natural persons entering into an agreement directly related to their business where it is not of a professional nature for them.
- You may withdraw from the agreement within 14 days of the first payment, without giving a reason
- We then refund the full first payment — we do not deduct the value of the service used up to the withdrawal
- The simplest way is in the dashboard: Settings → Billing → “Withdraw from the agreement”. The button is available for 14 days after the first payment, and we e-mail a confirmation with the date and time
- You may also send a statement by e-mail to [email protected], including on the model form in the Annex. It is enough to send it before the deadline
- Withdrawing during the trial ends the subscription at no charge
- Refunds are made to the original payment method within 14 days of receiving the statement
- By proceeding to payment, the User requests that the service start before the withdrawal period ends — we collect this consent on the payment screen
- The right of withdrawal applies to entering into the agreement, not to its automatic renewals. Cancelling before the end of the paid period prevents renewal
12. Complaints
- We accept complaints by e-mail at [email protected]
- A complaint should include the Account e-mail address, a description of the problem and the expected resolution
- We respond within 14 days of receipt, to the e-mail address it was sent from
- If we do not respond within that time, the complaint is deemed accepted
- If the service does not conform to the agreement, Consumers and Sole traders with consumer rights may demand that it be brought into conformity and, if that is impossible or ineffective, a price reduction or withdrawal from the agreement (Arts. 43k–43q of the Polish Consumer Rights Act)
- If we do not accept a Consumer’s complaint, our response will say whether we agree to out-of-court dispute resolution
13. Personal Data
We process Users’ data as a controller under the Privacy Policy. We process Office Clients’ data as a processor on the terms in section 6.
14. Intellectual Property
All rights to the Service, including the Domyko mark, interface, source code and documentation, belong to the Operator. The Office receives a licence to use the Service under these Terms. The Office’s logo and materials remain its property; the Office licenses them for display in the Service for the term of the agreement.
15. Termination
The Office may cancel its subscription and delete its Account at any time.
The Operator may suspend an Account or terminate the agreement only for good reason:
- Breach of the rules in section 4
- Actions that threaten the security of the Service or other Offices’ data
- Non-payment of the subscription after all payment retries have failed
- Before terminating we ask by e-mail for the breach to be remedied within 7 days. Files containing malware are blocked immediately
- If we terminate for reasons the Office is not responsible for, we refund the unused part of the billing period
- Before data is deleted after the agreement ends, the Office can download an export (section 6)
16. Changes to these Terms
These Terms may change for good reasons: changes in law, changes in the scope or manner of providing the services, security reasons or a change in the Operator’s details.
We announce changes by e-mail at least 14 days before they take effect. An Office that does not accept them may terminate the agreement before they take effect — we then refund the unused part of the billing period.
17. Governing Law and Disputes
These Terms are governed by Polish law. Disputes are resolved by the court competent for the Operator’s registered office, subject to consumers’ right to choose the court.
Consumers may use out-of-court complaint and redress procedures, in particular the help of a district (municipal) consumer ombudsman, the provincial Trade Inspection inspector or a consumer organisation. Using them is voluntary and requires the consent of both parties.
